These Terms of Use ("Terms") are a binding agreement between you and Danil Soroka, an individual entrepreneur (trabajador autónomo) registered in Spain, tax ID (NIF) Z2657671A, business address Avenida de l'Oeste 39, 46001 Valencia, Spain ("HatQuiz," "we," "us"), governing your use of the website https://hatquiz.com and related services (the "Service").
By accessing or using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
HatQuiz offers entertainment quizzes (e.g., personality-type, compatibility, and lifestyle quizzes). Depending on your plan:
Entertainment only. Quiz results and AI cards are for entertainment purposes. They are not psychological, medical, relationship, career, or any other professional assessment, diagnosis, or advice, and must not be relied upon as such.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older. We do not knowingly allow minors to use the Service or process photos of minors (see Section 7).
Illinois (USA). The photo-upload and AI-card features of the Service are not available to residents of the State of Illinois. Before uploading any photo, you will be asked to confirm that: (a) you are at least 18 years old; (b) you are not a resident of Illinois; and (c) you have reviewed how your photo is processed (Section 3 of the Privacy Policy). By uploading a photo you make these representations. We may restrict availability in other jurisdictions where these features would be unlawful.
You may browse and answer quiz questions without an account, but viewing results and all paid features require an account. Authentication is provided by Clerk (email/password or Google sign-in). You are responsible for keeping your credentials secure and for all activity under your account. You must provide accurate information and maintain one account per person.
You may request deletion of your account and associated data by contacting hatquizz@gmail.com. We will process deletion requests within 30 days.
HatQuiz Premium is an automatically renewing subscription processed by Stripe. Available plans and prices are shown at checkout before you subscribe. Current plans:

Refunds are governed by our Refund Policy: the first payment is covered by a 14-day money-back guarantee minus a published per-generation deduction for AI cards you generated; other payments are non-refundable except for billing errors, discretionary refunds, and mandatory consumer rights (including the EU/UK statutory right of withdrawal).
Premium includes AI-card generation, all visual styles, and access to all quizzes, including the couples quiz. Generation is subject to reasonable daily fair-use limits, which we may adjust to maintain service quality and prevent abuse. Current limits are displayed in the product. Free accounts are limited to 3 text quiz runs per day.
AI-card generation typically takes 1–3 minutes and may occasionally fail. Failed generations are not charged separately (Premium is a subscription, not pay-per-generation), and you may retry a failed generation.
To generate an AI card, you upload a photo and answer quiz questions ("User Content"). You retain ownership of your User Content.
You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely to operate the Service for you: to generate your AI card (including transmitting your photo to our AI-generation provider, currently OpenAI), display results to you (and, for the couples quiz, to your quiz partner), and provide support. This license ends when your content is deleted, except as needed to comply with law.
We do not use your photos or AI cards for marketing without your separate, explicit consent, and we do not use them to train AI models.
By uploading a photo, you represent and warrant that:
We may use automated and manual moderation and may remove content or suspend accounts that violate these rules.
Uploading a photo is optional and only needed for AI cards. Before your first upload, you will be shown a dedicated consent screen where you confirm that you are 18 or older, that you are not an Illinois resident, and that you have reviewed how your photo is processed, and you give explicit consent to the processing of your photo as described in the Privacy Policy (including transfer to our AI-generation provider). We keep a record of your consent. Details on how photos are stored, for how long, and how to delete them are in the Privacy Policy. We do not use facial recognition and do not identify, search for, or match people by their faces.
For the couples quiz, one user creates an invitation and the other joins via a unique link. By participating, each of you consents to (a) your quiz answers being combined into a joint result and (b) your stylized portrait appearing on a shared AI card that is visible to both participants and may be shared by either of you. If you do not want your portrait on a shared card, do not participate or do not upload a photo.
Subject to your compliance with these Terms, we grant you the right to use, reproduce, publish, and share the AI cards generated from your content for personal, non-commercial purposes. AI cards may include a HatQuiz watermark.
AI limitations. AI cards are generated by machine-learning models and may contain artifacts, inaccuracies, distorted likeness, or garbled text. We do not guarantee any particular quality, resemblance, or output.
You agree not to: use the Service unlawfully or to harm others; upload prohibited content (Section 6); attempt to circumvent limits, paywalls, or security; scrape, reverse-engineer, or resell the Service; use the Service to harass, impersonate, or deceive anyone (including creating misleading depictions of real people); or interfere with the Service's operation.
The Service — including quiz questions, archetype descriptions, designs, software, the HatQuiz brand and logo — is owned by us or our licensors and protected by intellectual-property laws. Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, or distribute our content without permission.
The Service relies on third-party providers (including Clerk for authentication, Stripe for payments, and OpenAI for image generation). We are not responsible for third-party services' availability, and their terms may apply to your interactions with them (e.g., Stripe's payment terms).
The Service is provided on a subscription basis but is under continuous development. We may add, modify, or remove quizzes, styles, and features at any time. If a change materially reduces the core value of your paid subscription, your remedy is to cancel (and, where applicable, request a refund under the Refund Policy).
You may stop using the Service and delete your account at any time. We may suspend or terminate your account for violation of these Terms, suspected fraud or abuse (including refund abuse), or where required by law. Upon termination, Sections 6 (representations), 9, 11, 15–18 survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR UNINTERRUPTED AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CONSUMERS HAVE UNDER MANDATORY LAW OF THEIR COUNTRY OF RESIDENCE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW (E.G., WILLFUL MISCONDUCT, OR NON-WAIVABLE CONSUMER RIGHTS).
You will indemnify us against third-party claims arising from your User Content or your breach of these Terms (in particular, uploading photos of third parties or minors without authority), to the extent permitted by applicable law.
These Terms are governed by the laws of Spain, without prejudice to mandatory consumer-protection rules of your country of habitual residence, which remain unaffected.
If you are a consumer in the EU/EEA, you may bring proceedings in the courts of your country of residence or of Spain. For all other users, the courts of Valencia, Spain have exclusive jurisdiction.
EU consumers may also use the European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).

We may update these Terms. For material changes we will give notice (e.g., email or in-product) before they take effect; continued use after the effective date constitutes acceptance. If you disagree, stop using the Service and cancel your subscription.
